Obamaspeak or the Rule of Law???

We are protected from tyranny by our legal system. The The Constitution was written to guard those liberties, with the Supreme Court as its interpreter. The Court, however, has become increasingly political and routinely interprets laws consistent with whatever it views as “fair” or helpful to liberals. The cancerous growth of the Federal Government, in direct violation of the Constitution, is obvious to anyone with an IQ above room temperature. The public has finally awakened to the danger and seems to be prepared to fight back. Not a moment too soon…

Expedience, particularly in wartime, or presidential disdain are the problems. One need only look at the dismissive attitude and actions of Dishonest Abe during his war:

He arbitrarily suspended habeas corpus, perhaps the most important vehicle by which liberty can be maintained. It is axiomatic that if a political leader can arrest and detain any person for any reason, there is no liberty. When Justice Roger Taney, declared that only the Congress could suspend habeas corpus, and ordered individuals released, Lincoln simply ignored the law. Further he arrested and banished an inconvenient Ohio politician to the Confederacy for insufficient “right think”. That authority must lie with abortion in the “penumbra”.

FDR’s vote buying “New Deal” was largely struck down by the Court. FDR attempted to retaliate, in 1937, by “packing the court” via an increase the number of Justices (one each for sitting members over the age of 7o&1/2). The plan did not get through Congress and it died. The Court was beginning to get the message that it had better reread the Constitution with an emphasis on expedience. That led to its most disgraceful failure, allowing the FDR government to place in concentration camps 100,000 Americans because of their race.

Hitherto the modern Court has found it convenient to hide behind the Commerce Clause as it allowed the Feds to erode our freedoms and expand its tentacles. This “stretch” has been disgraceful and it always served whichever Democrat did not want to force Congress to take an inconvenient vote.

The Court will soon be confronted with the Obamacare challenge. Three justices actually have read the Constitution and, perhaps, someone has read it to Justice Sotomayor. The others “read” expanded government and decreased personal freedom in every clause in an effort repay those that appointed them. Republican presidents are repaid differently than Democrats.

The rub this time is that, with at least 16 state plaintiffs, there will be a Constitutional crisis if the Court simply averts it eyes and applies the rubber stamp as usual. As the Court tests the winds, each additional state that joins the suit raises the chance that Obamacare will be struck down. In this case, politics will work to the advantage of those opposed to Obamacare. We should take no joy in that.

If Obama, et al. prevail, the battle is hardly over. There will be seething contempt throughout the nation as states find ways to thwart this law. A state could refuse to allow Federal Agents to harass its citizens, or instruct its citizens to withhold a percentage of Federal tax equal to the Federal predation. What then does The Won do??

For the record, no Confederate was ever tried for treason as there was no Constitutional basis for trial. Rather than risk an acquittal, which would demonstrate Lincoln’s war to have been illegal, they were simply released. Think about it.
