Oklahoma: standing tall in the fight against illegal aliens and Obama’s health care scheme

Two recent stories coming from Oklahoma make it clear it’s the home of the free and the land of the brave.

Randy Terrill, R-Moore an Oklahoma State Representative has taken a big step toward ridding the state’s public schools of the illegal aliens who are taking up space, demanding services and pushing out American citizens. Under Terrill’s proposal all public schools in Oklahoma will be required to verify the citizenship status of each of its students. They are to report their findings to the state’s Department of Education in a timely fashion.

Not surprisingly both a Hispanic group from Tulsa and the city’s Public Schools Superintendent have jumped to criticize the plan.

Spokespersons for the Tulsa Hispanic Chamber of Commerce (THCC) called Terrill’s bill (House Bill 3384) an unfunded mandate and a step toward permanently denying illegal immigrants the government school education they are presumably entitled to receive.

Speaking like a child who wants what he wants purely based on the grounds that he wants it, a spokesman for the THCC said, “By denying undocumented students a basic education, we deny them the ability to live within civic institutions and structure and foreclose … the possibility they will contribute in even the smallest way to the progress of this state.”

In response Representative Terrill said he “….. has no firm plans for using the data that would be collected by the schools.” He did say, however, that he expects the data to show the cost of educating illegal immigrants to be “stunningly high.”

Oklahoma swinging the sword of the Tenth Amendment

This week a resolution was passed by the Oklahoma House of Representatives that directs Oklahomans be allowed to vote on a state Constitutional amendment on whether or not they should be forced to opt out of Obamacare’s required participation.

The Tenth Amendment

The biggest obstacle to the Marxist putsch against our freedoms by Obama and his Democrats is the Tenth Amendment to the Constitution.

When you stand up to fight for America remember recognition is always the least important reward. When you fight for the freedoms that come with being an American you will be shoulder to shoulder with the same type of patriots who fought hand to hand against the British to found our great nation.

Parliamentary Landscape with a Presidential System

The Founders of our Republic did a truly amazing job in the creation of the Constitution. They anticipated the pitfalls of an overly strong central government and those of a nation without a resilient central government.

James Madison, writing as “Publius” in Federalist #10: “The federal Constitution forms a happy combination in this respect; the great and aggregate interests being referred to the national, the local and particular to the State legislatures.” He obviously did not anticipate the never ending debasement of the Tenth Amendment, but was fully aware of the danger of “factions” (political parties, etc.) and their ability to suborn the common interest to particular interests. He accepted the fact that men would form factions but was convinced that the power delegation between federal and state would alleviate the danger.

He expected “interests” (special interests, in today’s jargon) to form and attempt to use the federal government in support, but believed that these attempts would fail. Events have made it clear he was half right.

George Washington was also clear in his 1796 Farewell Address, regarding “factions”: “Liberty … is, indeed, little else than a name, where the government is too feeble to withstand the enterprises of faction … and to maintain all in the secure and tranquil enjoyments of the rights of person and property.”

“One of the expedients of party to acquire influence…is to misrepresent the opinions and aims of other[s]. You cannot shield yourselves too much against the jealousies and heart burnings which spring from these misrepresentations; they tend to render alien to each other those who ought to be bound together by fraternal affection.”

The net of this is simple: Our Constitution, with its presidential system, was designed to work without national party influence, making representatives of particular constituents unable to reward their “interests” with Federal largesse. Twelve trillion in debt indicates abject failure.

Washington’s prescient analysis of the dangers of political parties should give pause. Both he and Madison were correct and built in the Constitutional strictures by which we could have avoided the disgraceful abuses by the Federal government currently on display.

At this unhappy place, a parliamentary system with its “factions” in which the government rises and falls as one, might be more appropriate but…we do not have one. We must deal with the mess we made with the tools at hand. Adherence to the plain language of the Constitution would resolve it. That of course is beyond hope.

Political parties are here to stay but there is hope that the obnoxious and dangerous growth of corrupt and corrupting government can be contained and/or reversed. The nation is becoming a house divided which, according to Dishonest Abe Lincoln cannot stand. The Constitution as it is currently construed cannot help. Libertarians, Tea Partiers, and other patriots see the approaching wreck and are laboring to avoid it.
The salient question: Will they succeed?? If they do not, we do not.

Which outrage will get us the Supreme Court 10th Amend test case we need to defeat Obama’s plot?

The Tenth Amendment showdown is coming. A Supreme Court test case on the power of the Tenth Amendment is coming.

There are several possibilities, but here’s my list.

Homeland Security has withdrawn the authority to round up illegals from Maricopa Arizona County Sheriff Joe Arpaio. Arpaio won’t back down rightly claiming he works for Maricopa County not the federal government.

Gun control laws

When the USSC invalidated the handgun laws of the District of Columbia, Chicago passed an even more restrictive law and dared Second Amendment supporters to challenge it, and the NRA has.

When Chicago loses it will create a power vacuum in states. Conservative states’ governments won’t stand for the new restrictive laws certain to be passed by their liberal controlled cities like Dallas, Houston, New Orleans in response to Chicago’s defeat. Those laws will be supported by Obama’s Justice Department and will bring about a 10th Amendment test case on gun control laws.

Overreaching EPA

The Federal EPA is choking off water from the farms in California’s San Joaquin Valley to save a fish. California might not bring a 10th Amendment case to fight this outrage, but it’s very possible the state of Florida will defeat the federal government’s edict to stop sport fishing in the Gulf of Mexico by using the 10th Amendment.

Obama’s sellout to the UN on “Climate change”

Kerry and Boxer will roll approval of a treaty with the UN to force America to “pay” for our supposed “climate change crimes against humanity” into a new Cap and Trade package in an effort to sneak it into law. A 10th Amendment case against this from Texas and/or other states wouldn’t be surprising.

When the results of this survey are in I’ll revisit this question. The Tenth Amendment is our magic Jedi sword handed down to us by our wise Founding Fathers. Specifically James Madison, the main author of the Bill of Rights, knew there would come a time like this when the federal government would over reach and grow large enough to choke off the rights of the individual states. Madison understood the Federal Government is a creation of the sates NOT the other way around so he crafted the Tenth Amendment to give us a way to fight back..

States of Rebellion

Texas Governor Rick Perry was recently pilloried for bringing up the concept of secession (“succession” according to leftist political commentator Whoopi Goldberg). He did not, and was not, advocating it but the word obviously struck a nerve in the White House and its MSM trumpets. Everything the left does depends on financing from low tax states such as Texas, Nevada, and Florida. Low state taxes maximize income tax receipts, which help pay for the welfare state and vote buying so important to “liberals.”
No person with an IQ above room temperature can read our Constitution and believe those states that joined the fledgling United States had rescinded their right to leave. The Tenth Amendment’s clarity puts to rest any doubt. It serves no purpose to rehash Dishonest Abe’s war against his peaceful neighbors and political opponents so I won’t.
In any event, the Feds have managed to entangle states so well that it would be very difficult even to build a majority for secession. Too many of every state’s citizens have a vested interest, against seceding from the Federal Government.
The inability to actually leave the United States legally, however, only partly truncates the drive for liberty of every Libertarian and most Conservatives. For instance, Andrew Jackson didn’t want a Bank of the United States and the issue ended up at John Marshall’s Supreme Court. Marshall et al. found for Jackson’s adversary which enraged President Jackson. He responded contemptuously, “Justice Marshall has made his ruling now let him enforce it.” Since Marshall had no enforcement mechanism, Jackson’s refusal to accept the ruling and not recertify the bank stood. Justice Roger Taney made several rulings that Dishonest Abe found troublesome, so he simply ignored them and pressed on with his war.
Presidents Jackson and Dishonest Abe have shown us the way.

States and state courts should simply ignore rulings and regulations that they find encroach on their rights. States, for instance, can begin to stop sending education money to DC to be stolen or wasted. They can then make sensible use of it to actually educate students absent Nanny State, politically correct, corrupt Feds.
States and/or localities may choose to simply ignore DEA or Federal Agents and decline to enforce Federal drug laws. Federally mandated speeding laws or DUI blood alcohol levels should and could be remanded to states or even localities. What precisely could the Federal government do? It could threaten to cut off funds and the threatened states could simply decline to send the same amount.
Perhaps, like Dishonest Abe, President Obama would send in the Army to kill as many of the objectors as he deems necessary. Methinks not.
As anger grows, and our freedoms are further eroded, there will be a serious movement toward state sovereignty. It has actually already begun as states pass laws in conflict with Federal drug laws or simply ignore them. The Feds only know to keep encroaching, it is time we made clear that we have had enough.

Man up Schwarzenegger: use the 10th amendment to save the San Joaquin farmers.

The agony of the San Joaquin Valley farmers continues.

They’re losing their homes and life savings because the lunatics in the Environmental Protection Agency (EPA) and a heartless judge care more about a fish than human beings. The EPA has dammed off 90% of the Valley’s water supply because they want to protect the Delta Smelt.

The Obama Administration simply doesn’t give a damn that they are killing these people.

This can end today if California Governor Arnold Schwarzenegger stops wimping out, man’s up and acts decisively.

If Schwarzenegger shows the fighting spirit that made him a champion body builder he can actually be the kind of hero he played in the movies. As a Governor he has to step up and claim control of the situation under the Tenth Amendment.

Power of the Tenth Amendment

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

These 28 words must be used to save the lives and farms of hard working Americans. Our Founding Father’s gave us this power specifically to protect us from Obama-like governments. Using them ends the agony today.

Schwarzenegger can use the 10th Amendment to tell the EPA to get lost

Spending State funds to feed people who should be feeding the world is crazy and un-American. This must stop.

If Schwarzenegger takes this step and personally opens the dam that’s killing the Californians he is constitutionally sworn to protect, he’ll be fulfilling his oath of office.

He’ll also lead the fight against the tyranny of unelected bureaucrats bent on destroying our lives every day.

Man up Arnold: use the Tenth Amendment as the sword against oppression it was written to be. Ask yourself: “What would Conan do?”

America’s Second Civil War

There is a second civil war coming Arnold. You can’t stop it. But you can join the right side. This new Civil War won’t be fought in the streets with guns. It will be fought out in our courthouses with the Tenth Amendment. You and others who claim to love American freedom can lead or step aside.

You can stand tall and prepare to speak out for America as it ought to be. You can face the hostile Democrat controlled media for doing the right thing and be a great American hero, or you can prepare condolence remarks for the people who will die without your help.

Be a man Arnold, you came to America and she gave you opportunities beyond your fondest dreams. Now it’s time to give something back to your country, our country. America needs Conan not Kindergarten Cop.
